In this document, "Yellow Van" refers to Serve IT & Services Private Limited. "Parents" or "Guardians" are the service users who track the driver's location. "School administration, Van/bus owner, Van/bus Vendors, Drivers" are the users of Yellow Van's services. The term "party" refers to either the parent, School, Van/Bus Owner or the driver, or all.

1. Service Provision:

Yellow Van provides a technology platform that enables parents to track the location of school vans in real time. The service is designed to enhance the safety and efficiency of school transportation by providing accurate and up-to-date information on the whereabouts of school vans.

2. Route Planning:

The platform assists van drivers in planning routes for the efficient pickup and drop-off of children. This feature ensures that drivers can optimize their routes, saving time and fuel while ensuring timely and safe transportation of students.

3. Navigation Assistance:

The driver app provides drivers with easy access to the pickup locations and route maps. This functionality ensures that drivers have all the necessary information to navigate their routes efficiently, reducing the likelihood of delays or missed stops.

4. Pickup and Drop-Off:

Parents are responsible for ensuring that their children are picked up and dropped off at the van or the designated assembly point at the specified times. Timely arrival and departure are crucial for maintaining the schedule and ensuring the safety of all students.

5. Responsibility Disclaimer:

Yellow Van is not responsible for any issues, incidents, or accidents related to the driver or the van under any circumstances. While we provide the technology platform to enhance safety, the actual operation and safety of the vans are the responsibilities of the drivers and van owners.

6. Compliance:

Drivers must adhere to all guidelines and regulations set by the school and the government regarding school transportation. This includes but is not limited to compliance with traffic laws, safety standards, and any specific rules set by the educational institutions.

7. Payment Disclaimer:

Yellow Van is not involved in and does not take responsibility for any financial transactions or agreements between parents and drivers. Any payment-related issues should be resolved directly between the involved parties.

8. Amendments:

Yellow Van reserves the right to amend, modify, or withdraw its terms and conditions at any time without prior notice. Users are encouraged to review the terms regularly to stay informed about any changes.

9. Jurisdiction:

All legal disputes arising from the use of Yellow Van's services are subject to the exclusive jurisdiction of the competent courts in Delhi. This clause ensures that any legal proceedings are conducted within a specified legal framework.

10. Road Rules:

Drivers must comply with all road rules and traffic regulations to ensure the safety of the children. Non-compliance with traffic laws not only endangers the safety of the passengers but also violates the terms of service.

11. Government Guidelines:

Drivers must adhere to all government guidelines related to the operation of school vans and buses. Yellow Van will not be held accountable for any driver's non-compliance with these guidelines.

12. Liability Disclaimer:

Yellow Van is not liable for any direct or indirect issues arising from the use or non-use of its services by parents, drivers, or any other parties. This includes but is not limited to any damages, losses, or legal issues that may arise.

13. User Responsibility:

Yellow Van is not responsible if any user (parent, driver, or others) is found guilty of any wrongdoing or illegal activities. Users are expected to conduct themselves responsibly and adhere to all relevant laws and regulations.

14. Service Recommendation:

Yellow Van recommends using its van tracking services, but any pre-existing agreements between parents and van drivers are independent of Yellow Van and its terms. Users are advised to clarify and agree on all terms and conditions with each other directly.

15. Payment Disputes:

Yellow Van is not responsible for any financial disputes or payment issues between parents and drivers. Any issues related to payments should be resolved between the parties involved.

16. Damage Liability:

Yellow Van is not liable for any damages caused by any user (parent, driver, or others) directly or indirectly. Users are responsible for their actions and any resulting consequences.

17. Documentation Compliance:

It is the responsibility of the van/bus drivers and owners to ensure all necessary documentation and permits are up-to-date and compliant with RTO, government, and school transport guidelines. Failure to comply with documentation requirements is the sole responsibility of the driver/owner.

18. Accident Responsibility:

In the event of any accidents or mishaps involving the van/bus, Yellow Van is not liable under any circumstances. All liability rests with the driver and van owner, who must ensure they have appropriate insurance and safety measures in place.

19. Penalty Responsibility:

Parents, drivers, or van owners are solely responsible for any penalties or levies imposed on them by any authority. Yellow Van is not responsible for any fines, penalties, or legal actions taken against any user.

20. Safety and Security:

The safety and security of the children are the responsibility of the school, van/bus drivers, van/bus owners, and parents/guardians. Yellow Van is not liable for any incidents affecting child safety, including but not limited to accidents, abductions, or any form of harm.

21. Insurance Claims:

No insurance party/firm/company/organization associated with any user of Yellow Van can claim any compensation for losses, damages, or forfeitures related to the service. All insurance matters should be handled directly between the user and their insurance provider.

22. Use of Technology:

Yellow Van's technology platform is intended to enhance the safety and efficiency of school transportation. Users must use the technology responsibly and as intended. Misuse of the app or any part of the service may result in suspension or termination of access.

23. Data Privacy:

Users' personal information and location data are collected and used in accordance with our Privacy Policy. We take data privacy seriously and implement various security measures to protect users' information. Users must also take reasonable steps to safeguard their data and report any suspected breaches immediately.

24. User Conduct:

All users of Yellow Van's services are expected to conduct themselves in a respectful and lawful manner. Any behavior that disrupts the service, endangers others, or violates any laws will not be tolerated and may result in termination of access to the service.

25. Support and Communication:

Yellow Van provides customer support to assist users with any issues or questions they may have. Users can contact support via email or phone for assistance. All communications with support should be conducted respectfully and professionally.

26. Service Availability:

While Yellow Van strives to provide uninterrupted service, there may be times when the service is unavailable due to maintenance, technical issues, or other unforeseen circumstances. Yellow Van is not liable for any disruptions in service and will work to resolve any issues as quickly as possible.

27. User Feedback:

Yellow Van values user feedback and encourages users to share their experiences and suggestions. Feedback can be submitted through the app or via email. User feedback helps us improve our services and address any concerns promptly.

28. Service Termination:

Yellow Van reserves the right to terminate access to its services for any user who violates the terms and conditions or engages in behavior that is deemed harmful or inappropriate. Termination of service is at the sole discretion of Yellow Van.

29. Dispute Resolution:

Any disputes arising from the use of Yellow Van's services should be resolved amicably between the parties involved. If a resolution cannot be reached, the dispute may be escalated to the appropriate legal authorities as outlined in the Jurisdiction section.

30. Indemnification:

Users agree to indemnify and hold Yellow Van, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses arising out of or related to their use of the services or violation of these terms.

31. Third-Party Services:

Yellow Van may integrate or use third-party services to enhance its offerings. Users must comply with the terms and conditions of these third-party services. Yellow Van is not responsible for the actions or policies of these third parties.

32. Intellectual Property:

All content, trademarks, and data provided by Yellow Van are protected by intellectual property laws. Users may not reproduce, distribute, or create derivative works from any of the content without explicit permission from Yellow Van.

33. Notifications:

Yellow Van may send notifications and alerts to users regarding important updates, service changes, or other relevant information. Users are encouraged to keep their contact information up-to-date to ensure they receive these notifications.

34. Force Majeure:

Yellow Van is not liable for any failure or delay in performing its obligations under these terms due to events beyond its reasonable control, including natural disasters, strikes, or other force majeure events.

35. Severability:

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, so that the remaining provisions remain in full force and effect.

36. Entire Agreement:

These terms and conditions, along with the Privacy Policy, constitute the entire agreement between the user and Yellow Van regarding the use of the services. Any modifications or amendments must be made in writing and signed by both parties.

37. Governing Law:

These terms and conditions are governed by and construed in accordance with the laws of India. Users agree to submit to the exclusive jurisdiction of the courts located in Delhi, India, for any disputes arising out of or relating to these terms.
